Injunctions at the Law Office of Maggie Jo Hilliard, P.A.

             An injunction for protection provides a petitioning person with a legal protective order to permit prosecution upon violation.  The intent of an injunction is to provide the petitioner a legal order against someone who threatens the petitioner's life and safety.              It is not uncommon for petitioners to abuse this legal remedy in heated, emotional interpersonal relationships.  However, there are many instances where injunctions are required to provide fearful petitioners a legal remedy when respondents fail to respect the order of the court.

 

             In order to receive an injunction, a petition for injunction must be filed in the Circuit Court.  After filing , a temporary injunction is in effect once a respondent is properly served with notice of the injunction.  Shortly after the filing and service of a temporary injunction, a hearing will be held before the Circuit Court Judge to determine the necessity and legality of the injunction and the necessiity for a permanent injunction.   This hearing is importannt, as the Circuit Court Judge could find that an injunction AND other requirements are necessary to protect the petitioner (i.e. domestic battery and anger management courses). 

 

If the judge grants the injunction, the respondent may be restricted from the following:


  • Committing violent acts against the petitioner, children or other household     members

 

  • Living in the home of the petitioner. 

 

  • Contacting the petitioner at home, work or other frequently visited places. 

 

  • Taking/visiting children. Temporary custody may be placed with the petitioner. r.

 

  • Refusing to go to counseling.
